Terms of Hire

Definitions and Law

 

The contract is the document/documents that set out these conditions and all other details about your agreement with us. ‘We’ and ‘Us’ ‘Owner’ and ‘Our’ and ‘WP Events’ mean the supplier of the goods. ‘You’ ‘Your’ or ‘Hirer’ means the hirer of the goods and their representatives. The ‘Goods’ means all goods hired to you by us. ‘The recipient’ means the person, firm, company, corporation or public authority to whom the goods are delivered, when it is not you. These conditions exclude any terms and conditions you may have put forward, except where we have agreed to any amendments or other conditions in writing. 

TERMS of HIRE

 

Bookings are only confirmed once the agreed deposit (25%) has been paid in full. By paying this deposit you are bound by the terms within this agreement.

 

Upon confirmation of the booking, we will guarantee the price quoted unless any changes are made to the original booking. Changes are defined as amendment to original quantities, change of options, a change of event date, customisation requested, amendment to hire period duration or any other changes to the original booking. Where changes are made to reduce overall cost, WP Events reserve the right to charge the original agreed price unless otherwise agreed.

 

28 days prior to the hire start date 100% of the agreed amount must be paid in full otherwise the booking may be cancelled with no refund offered.

 

If you wish to make amendments to your booking you must do so at the earliest opportunity. We cannot guarantee any amendments once booking is confirmed but we will make every effort to accommodate.

We reserve the right to substitute items to an equal or higher value, where your chosen items are unavailable or arrive in poor quality. We will consult you before any changes are made.

A security deposit will also be held during the hire term and will be refunded to the hirer upon completion of the hire period and once all goods have been returned in a satisfactory condition.

 

COVID-19 POLICY:

 

Should your event plans be affected by COVID19 restrictions or should you wish to postpone your event. We are offering 1 date change free of charge. This date change must be within 12 months of the original booking date. 

If your chosen items are not available on your new date, we will exchange them to items of an equal value at no extra charge. If the amount is higher than the original order, we will just ask you to pay the difference. If the amount is lower than the original order amount, we will require you to make up the difference. No refunds will be given.

 

If your chosen items are still available but you have changed your mind on colours/styles. Then no refunds will be given however an exchange may be honoured where possible at our discretion.

 

Any additional postponements/date changes will be subject to our usual terms and conditions outlined below. 

We cannot offer refunds or exchanges on items that have been custom made or special ordered in for your event. You may be also charged for any time that we have spent sourcing these items. 

 

If you decide to proceed with your order with a reduction in guest numbers, we will exchange any unwanted items to an equal or higher value at our discretion. with any additional fees to be covered by the hirer. If you do not wish to exchange, then the deposit on those items will be lost.

 

If you decide to cancel your order completely then our usual terms and conditions outlined below will apply. 

General Conditions of Hire

 

We shall make our best efforts to supply you with the goods requested, but we reserve the right to supply you with similar goods for equal or higher value at no extra charge. All goods for hire remain the property of WP Events.

 

Deliveries to third parties or unoccupied premises are made entirely at the hirers own risk. We are not responsible for the goods and their care once they have been delivered to the premises. Where possible we advise that you have a representative meet us at the time of delivery to check through the order for any shortages and breakages before they leave our care. Once items leave our care, they will be presumed to be of a satisfactory state and the correct quantities unless we are notified within one hour of delivery. Any losses or damages after this point will be the responsibility of the hirer. 

 

Prices quoted are for the days stated on the booking form only and must be returned to us within this time frame. Items returned late, or failed deliveries and collections will be charged for again at the full hire price or the full delivery/collection fee. This fee will be debited from the security deposit.

All hired items must be kept indoors unless otherwise agreed. Use of wax open flame candles must be agreed prior to hire. Any damage caused by wax or open flames will be debited from the security deposit.

 

Payments and Booking

 

A non-refundable deposit is required to reserve your booking . Deposit information will be detailed on your booking form and will either be 100% of the total balance or a percentage of the total amount. Bookings can be made by email, in person or over the phone. Payments can be paid by either BACS, credit or debit card or by cash. An invoice will be provided as proof of payment. We unfortunately do not accept cheques. Please note that the booking is not confirmed until the deposit has been paid. The final total payment is required in full no later than 30 days before the event, unless otherwise stated. If payment is not received within our terms and conditions, we will assume that our services are no longer required, and your booking cancelled. No refund of the deposit will be offered as per the conditions of the hire. If at any stage, you become aware of a late payment you must contact us before 30 days of the event date to avoid cancellation. We will make every effort to inform you that you have an outstanding balance, however all monies owed are the responsibility of the client and the responsibility to pay on time it with the client. A security deposit will be required before any items are hired. The security deposit will be refunded upon return of all hired items and that they are returned in satisfactory condition.

 

Loss or Damages:

 

A security deposit is required in full before the release of any hire items. The cost will be detailed at time of booking. If we do not receive this payment the booking will be considered cancelled by you, the hirer and no refunds will be offered. Please check the quantities provided are correct and that you are happy with the quality of the items. You must notify us within one hour of receipt of items if any item is missing or damaged otherwise it become the responsibility of the hirer and any losses/damages will be charged.

Shortages or damages will be charged at the full replacement value of each item.

Failed collections and returns: Failed collections and return due to items not being ready for us at the venue for us to collect will attract an extra collection charge. Please make sure all items are left in the agreed place for us to collect. You must ensure we have access to the venue for the agreed collection time.

 

Late collections/returns by the hirer: Failed collections or returns by the hirer will attract a fee if we must make an additional journey to meet you. We may also charge the hire fee again if you have had the items in your possession longer than the hire period stated on the booking form. In cases where we must cancel a future booking due to you returning the items late, we will also deduct any additional costs incurred from the security deposit and any costs in respect of loss of business. If this value exceed the security deposit then we will raise an invoice for any outstanding charges.

All orders must be returned to us at the address specified on the booking form. All orders must be returned to one of our representatives personally. We will not accept responsibility for any orders left on the premises unattended or left with any individuals not employed by or approved by WP Events. Goods must be returned in the containers that they were received in, including cardboard boxes and plastic crates. The loss of containers may be charged for and deductible from the security deposit. 

Amends to Orders and Cancellations: 

 

Amends to your order is accepted but will depend on availability and may occur additional charges. If you find that you would like to remove an item. We will happily allow an exchange or a credit note. Please allow as much notice as possible for any amends to your order. Amendments within 28 days of the event are not permitted unless agreed otherwise. Any amends of changes to your order must be done in writing.

 

In the event of a cancelled booking the deposit will not be refunded unless otherwise agreed.

 

Cancellation fees:

 

Within 28 days of event day                              -               100% of total hire cost

Within 90 days of the event                               -               50% of total hire cost

More than 90 days before the event               -               Deposit value

 

Cancellations within 28 days of the event will occur a 100% hire cost and no refunds will be issued. Where balance has not been paid, the balance must be paid in full. Failure to pay the balance may result in balance being passed to a debt collection agency.

 

Cancellations within 90 days of the event will occur a 50% of the total hire cost. This must be paid within 14 days from when you notify us of the cancellation. Failure to pay the balance within the 14 days may result in the balance being passed to a debt collection agency.

 

If you provide more than 90-day notice of the cancellation no further charges will be applied and we reserve the right to hold on to the deposit paid.

 

Should WP Events cancel your event we will issue notification at the earliest date possible and refund any deposit paid. Where possible we will make every effort to put you in touch with an alternative hire company.

 

Collections & Deliveries

 

We will not be liable for any direct or indirect costs or loss of business due to late collection or deliveries. Delivery times are an estimation, and we will make every effort to deliver on the time provided. Goods must be available for collection by us at the delivery address unless otherwise arranged. It is the hirers responsibility to ensure we have access to the venue for any deliveries or setup 24 hours before your event date. The hirer must also ensure we have access to the venue to pack-up and collect items with 24 hours after your event date. In the event we are refused access to collect any hired items, then an extra day charge and any subsequent days, will be deducted from the security deposit, Any entry restrictions to point of collection must be highlighted to us before collection attempt. Any restrictions for delivery must be highlighted to us before we attempt delivery. This includes road access, stairways, or opening hours access.

 

Any items missing or damaged will be charged for from the security deposit if they are not returned to us within 48 hours and no refunds will be given as detailed within the Loss and Damages policy.

 

When the goods on hire are collected by you or your representative, the goods need to be inspected for damages and shortages before they are taken from the premises. Any goods taken from the premises will be deemed to have been taken in a satisfactory condition.

 

Collections and returns are at allocated times specified on the booking form. If you do not turn up during the allocated times and the collection or return is aborted, we may not be able to guarantee to rearrange another time slot. If you feel you may need to rearrange, please give us plenty of notice, fees may be applied to repeat attempts to collect or return.

 

You are responsible for and loss or damages from the time of collection and return. Or in cases where we set up, from the time of delivery and set up until we collect the items. Deliveries left on unattended premises are left entirely at the hirers risk. 

We will not be held responsible for any delays because of circumstances beyond our control. This includes bad weather, acts of theft, or acts of nature. 

 

Items will be packed suitably for transport and care instructions will be given. Items should be inspected upon collection and any issues raised before the items leave our premises. We will not accept any responsibility for them after they have left our care. Delivery/set.

up and clearance may be available from us at an extra charge. For full set up customers any issues or shortages must be raised within 30 mins of delivery for us to have time to rectify the issue. 

 

Liability

 

We do not accept any liability for any damage or injury arising from the use or attempted use of candles provided by us. 

WP Events will not be held responsible for any injury or damage to persons or property however sustained, arising from any goods under hire. The hirer will be responsible for making sure all items are displayed and fitted correctly and safely to prevent damage or injury. WP Events shall be under no liability arising from neglect, wilful damage, abnormal usage conditions or failure to follow our instructions.

 

Clients leaving bad or negative feedback regarding a booking or cancelled booking which has a negative impact on our business without a just reason, or reasonable time to resolve any issues will be in breach of this contract. WP Events may take legal action to regain all potential loss of business. this includes social media, trade papers or forums.
